ORDINANCE NO. 92

 

AN ORDINANCE TO AMEND AND REENACT THE CHOUDRANT COMPREHENSIVE PLAN AND THE ZONING MAP OF THE VILLAGE OF CHOUDRANT;      TO CHANGE THE ZONING CLASSIFICATION OF CERTAIN PROPERTY OWNED BY RMD PROPERTIES, L.L.C. LOCATED IN THE VILLAGE OF CHOUDRANT, LOUISIANA; TO PROVIDE FOR THE EFFECTIVE DATE THEREOF; AND OTHERWISE TO PROVIDE WITH RESPECT THERETO.

 

 

 

             NOW, THEREFORE, BE IT ORDAINED, by the Board of Aldermen of the Village of Choudrant, Louisiana, convened in Regular Session this 6th day of August, 2007, that the following Ordinance is hereby enacted:

 

SECTION 1.

 

            The Choudrant Comprehensive Plan and the Zoning Map of the Village of Choudrant, Louisiana are hereby amended and reenacted as follows:

 

 

            The property set forth hereinafter shall be zoned R-2 (Medium Density Single-Family Residences) and subject to the zoning requirements set forth in Ordinance No. 65 of the Code of Ordinances of the Village of Choudrant, Louisiana:

 

 

 

TOWNSHIP 18 NORTH, RANGE 2 WEST

LINCOLN PARISH, LOUISIANA

 

Section 24        Commencing at an existing 3/4ths-inch conduit in an old fence

                        on a common boundary representing the NE corner of SW ¼ of

                        SE ¼ of NW ¼ of said Section 24 and run thence North 89

                        degrees 07 minutes 15 seconds West along said fence for a

                        distance of 143.10 feet to a 3/4ths-inch rebar and to the starting

                        point.  From said starting point and leaving said fence, run

                        thence South for a distance of 638.26 feet and to a 2-inch angle

                        iron set on the quarter section line, thence run West along the

                        quarter section line for a distance of 500.29 feet and to a metal

                        “T” post at a crosstie which marks the SW corner of SE ¼ of

                        NW ¼ of said Section 24 pursuant to survey by U.S.Roane, C.E.,

                        thence run North 00 degrees, 22 minutes, 26 seconds East for

                        a distance of 94.31 feet, and to a cotton picker spindle set in

                        the centerline of U.S. Highway 80, thence run North 00 degrees,

                        25 minutes, 31 seconds West along an existing fence on a

                        common boundary for a distance of 551.70 feet, and to an

                        existing crosstie in a fence corner, thence run South 89

                        degrees, 07 minutes, 15 seconds East along an existing

                        fence for a distance of 503.83 feet, and back to the point

                        of beginning, containing 7.392 acres, more or less, all

                        pursuant to Plat of Survey by William T. Lowe, PLS, dated

                        July 21, 2003.

SECTION 2.

 

            Except as amended hereinabove, all other provisions and zoning designations set forth on the Choudrant Comprehensive Plan and the Zoning Map of the Village of Choudrant, Louisiana, shall remain in full force and effect without change or alteration.

 

 

SECTION 3.

 

           

            If any section, paragraph, sentence, clause and/or phrase of this Ordinance or the application thereof is declared unconstitutional, unenforceable or invalid by the valid judgment of any court of competent jurisdiction such unconstitutionality, unenforceability or invalidity shall not affect any of the remaining sections, paragraphs, sentences, clauses and/or phrases of this Ordinance, since the same would have been enacted by the Village of Choudrant without the incorporation in this Ordinance of any such unconstitutional, unenforceable or invalid section, paragraph, sentence, clause or phrase.  To that end, the provisions of this Ordinance are hereby declared severable.

 

 

 

SECTION 4.

 

            All other ordinances, or any parts thereof, which are in conflict with the provisions of this Ordinance are hereby repealed.

 

 

SECTION 5.

 

            This Ordinance shall become effective after final adoption and publication in the manner prescribed by law.

 

 

 

      The above and foregoing Ordinance was introduced on July 2, 2007, at a regular meeting of the Board of Aldermen of the Village of Choudrant, Louisiana, a public hearing having thereafter been held, title having been read, and a motion to adopt said ordinance was made by Alderman O’Neal. The motion was seconded by Alderman Aswell, and after having been considered by title was adopted as a whole by the following YEA and NAY vote:

            ABSENT:        None
